1.1 This document is an electronic record within the meaning of the Information Technology Act, 2000 (“IT Act”) and the rules made thereunder, and is generated by a computer system; it does not require any physical or digital signature. It is published, to the extent applicable, in accordance with Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020, which require the publication of the terms of use, privacy policy, and grievance redressal mechanism applicable to users of www.CraftTijori.com (“Website”).

1.2 Craft Tijori India (“Craft Tijori India”, “the Company”, “we”, “us”, “our”) owns and operates the Website. By accessing or using the Website, or by placing an order for any product displayed thereon, the User (“User”, “you”) agrees to be bound by these Terms and Conditions (“Terms”) without any reservation whatsoever.

1.3 Craft Tijori India reserves the right to add, delete, alter, or modify these Terms at any time, in its sole discretion and without prior notice. The User is advised to review these Terms each time the Website is used. Continued use of the Website following any such change shall constitute unconditional acceptance of the revised Terms.

2.1 The Website may be used or accessed only by persons competent to contract under the Indian Contract Act, 1872. Persons who are minors, of unsound mind, or undischarged insolvents are not eligible to use the Website or to place an order thereon, and Craft Tijori India shall bear no liability whatsoever in the event of a breach of this Clause by any User.

2.2 Where a User accesses the Website or places an order on behalf of a business entity, such User represents and warrants that the entity has the requisite authority under applicable law, and that the User is duly authorised by such entity, to enter into and be bound by these Terms.

3.1 The Website is maintained by Craft Tijori India for the general information of visitors and to showcase its range of handicraft products.

3.2 Any purchase of a product displayed on the Website shall be concluded only through such other mode of communication as Craft Tijori India may specify or agree to from time to time.

3.3 Nothing on the Website shall be construed as an offer capable of acceptance by a User so as to create a binding contract merely upon browsing or viewing the same.

3.4 Nothing contained on the Website, including product descriptions, catalogues, images, pricing, specifications or promotional material, shall constitute a legally binding offer.

4.1 Craft Tijori India does not itself manufacture any of the products displayed on the Website. Craft Tijori India sources its products from independent artisans and handicraft manufacturers (“Artisans”).

4.2 As the products dealt with by Craft Tijori India are handmade or hand-finished, variation in colour, texture, size, finish, or other similar attributes between units of ostensibly the same product is inherent to the nature of such goods.

4.2A Actual product colours may vary slightly due to photography lighting, screen resolution, monitor calibration and mobile display settings.

4.2B Product dimensions, weight and finish are approximate and may vary within normal handmade manufacturing tolerance.

4.3 While Craft Tijori India exercises reasonable care in the selection of Artisans and products, it does not control, and shall not be responsible for, the manufacturing process, raw material sourcing, or labour practices of any Artisan, except to the extent liability is mandatorily imposed under applicable law.

5.1 All products and the prices thereof displayed on the Website constitute an invitation to offer only, and not an offer capable of acceptance.

5.2 Prices and availability of products are subject to change without prior notice. Where a product is indicated at an incorrect price on account of a typographical or technical error, Craft Tijori India reserves the right to cancel the order concerned.

6.1 An order for a product may be placed only through such mode of communication as Craft Tijori India may specify from time to time.

6.1A Craft Tijori India reserves the absolute right to refuse, suspend or cancel any order before dispatch, without assigning any reason, including pricing errors, suspected fraud, payment verification issues, stock unavailability or regulatory restrictions.

6.2 Payment for a confirmed order shall be made through such mode and at such time as may be agreed between Craft Tijori India and the User.

6.3 Orders placed by customers within India shall ordinarily be billed in Indian Rupees (INR). International customers shall be subject to applicable currency conversion charges.

6.3A GST shall be charged wherever applicable. International customers shall remain responsible for customs duties, VAT, GST, import taxes and local charges imposed in the destination country unless expressly stated otherwise.

6.4 Craft Tijori India may require additional identity verification before processing any order which appears unusual, high value or suspected to be fraudulent.

6.5 Craft Tijori India reserves the right to refuse shipment to any country, territory or person prohibited under applicable export control laws, sanctions or governmental restrictions.

7.1 Domestic orders are ordinarily delivered within the time committed over the email of confirmation of the order.

7.2 International orders are subject to customs clearance in the destination country. Any customs duty, import tax, or other charge levied by the destination country shall be borne solely by the User unless expressly stated otherwise.

7.2A Craft Tijori India shall not be responsible for delays arising due to customs clearance, quarantine inspection, import regulations, governmental authorities or other regulatory processes outside India.

7.3 Risk and title shall pass to the User upon handover of the shipment by Craft Tijori India, or its shipping partner, to the carrier for delivery.

7.3A After dispatch, delivery timelines remain subject to the operations of the logistics partner.

7.4 Craft Tijori India shall not be liable for delays or non-performance caused by events beyond its reasonable control, including natural disasters, war, terrorism, governmental action, strikes or interruption of transportation networks.

8.1 Craft Tijori India packages all products with reasonable care, having regard to the handmade and, in certain cases, fragile nature of its products.

8.2 Craft Tijori India may offer the User the option of availing Transit Insurance in respect of an order.

8.3 Where Transit Insurance has been purchased and the product is damaged in transit, Craft Tijori India shall facilitate the claim in accordance with the applicable insurance policy.

8.4 Where Transit Insurance has not been purchased, transit damage shall be governed by the applicable risk allocation under these Terms.

8.5 Any claim must be supported by an unedited and uninterrupted video recording of the unboxing of the shipment and must be submitted within 24 hours of delivery.

8.5A The User shall inspect the shipment immediately upon delivery and report any shortage, wrong item or visible damage within 24 hours.

9.1 A User may request cancellation of an order before it has been shipped.

9.2 A request for return, replacement, or refund may be considered where the product delivered is damaged, defective, or materially different from its description.

9.3 Where Craft Tijori India determines that a refund is due, the same shall be processed to the original payment method.

9.4 Nothing in this Clause shall be construed to affect any statutory right of a User that cannot lawfully be excluded or limited by agreement.

9.5 Where a User initiates any chargeback or payment reversal after successful delivery, Craft Tijori India reserves the right to contest such proceedings.

10.1 All content on the Website, including photographs, text, graphics, layout, and the name and mark “Craft Tijori India”, is the property of Craft Tijori India or its licensors.

10.2 As Craft Tijori India sources products from independent Artisans, the underlying design, craft technique, or artistic work embodied in a product may vest in, or be shared with, the Artisan concerned.

10.3 Where a product is identified as bearing a Geographical Indication, such indication shall be used only in relation to genuine products.

10.4 No content of the Website may be reproduced, copied, or otherwise used without prior written consent of Craft Tijori India.

10.5 No person shall scrape, reproduce, download in bulk, use artificial intelligence systems to reproduce or commercially exploit Website content without prior written permission.

10.6 No licence or right is granted to use the trade name, logo, domain name or other proprietary identifier of Craft Tijori India without prior written consent.

11.1 A User shall use the Website for lawful purposes only.

11.2 Any breach of this Clause shall entitle Craft Tijori India to refuse, cancel, or discontinue service.

11.3 Unless otherwise agreed in writing, products are intended for personal use only.

11.4 Users shall not post or transmit any false, defamatory, abusive, unlawful or misleading review, feedback or communication.

12.1 The Website and all content thereon are provided strictly on an “as is” and “as available” basis, without warranty of any kind, save to the extent any such warranty cannot lawfully be excluded.

12.2 Craft Tijori India takes reasonable care to ensure that product descriptions, images, and specifications are accurate but does not warrant that they are complete, current, or error-free.

12.3 Craft Tijori India does not warrant that the Website will be uninterrupted, secure, or free of error, virus, or other harmful component.

12.4 Craft Tijori India shall not be liable for temporary interruption, maintenance, cyber incidents, server downtime or technical failures affecting availability of the Website.

13.1 To the fullest extent permitted by law, Craft Tijori India shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss or damage.

13.2 The aggregate liability of Craft Tijori India to a User in respect of any single order shall not exceed the amount actually paid by such User for the product giving rise to the claim.

13.2A Craft Tijori India shall not be liable for loss of business opportunity, anticipated savings, business interruption, loss of reputation or indirect commercial loss.

13.3 Nothing in these Terms shall limit or exclude any right or remedy available to a User under applicable consumer protection law that cannot lawfully be excluded.

13.4 Users are encouraged to notify Craft Tijori India of any claim promptly.

14.1 The User agrees to indemnify, defend, and hold harmless Craft Tijori India, its directors, officers, employees, and agents from claims, liabilities, damages, losses, costs, and expenses arising out of the User's breach of these Terms, violation of law, false information, infringement of third-party rights, or misuse of the Website.

15.1 The Website may contain links to third-party websites that are not under the control of Craft Tijori India. Craft Tijori India assumes no responsibility for such websites.

16.1 Craft Tijori India reserves the right to add, delete, or modify the content, products, or information on the Website at any time and to suspend or discontinue the Website, in whole or in part.

17.1 Craft Tijori India may assign, transfer, or subcontract its rights and obligations under these Terms. A User may not assign or transfer any right or obligation without prior written consent.

18.1 No failure or delay on the part of Craft Tijori India in exercising any right, power, or remedy shall operate as a waiver thereof.

19.1 If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be severed and the remaining provisions shall continue in full force and effect.

20.1 These Terms, together with the Privacy Policy and any order-specific terms communicated to a User, constitute the entire agreement between the User and Craft Tijori India.

21.1 Any notice or communication required to be given by a User shall be in writing and sent to the contact details set out below. Craft Tijori India may communicate with a User using email, registered post, courier, WhatsApp, SMS, or other electronic mode recognised under applicable law.

21.2 Electronic records maintained by Craft Tijori India including invoices, dispatch records, payment confirmations, communication logs and system records shall constitute prima facie evidence of transactions to the extent permitted by law.

22.2 The Grievance Officer shall endeavour to acknowledge a complaint within 48 hours of receipt and to resolve the same within 1 month from the date of receipt.

23.1 In the event of any dispute, controversy, or claim arising out of or in connection with these Terms, the parties shall first attempt to resolve the same amicably through the grievance redressal mechanism.

23.2 Where a dispute is not resolved amicably within 30 days, the same shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Delhi, India, and the language shall be English.

23.3 Nothing in this Clause shall preclude Craft Tijori India from seeking interim or injunctive relief before a court of competent jurisdiction, nor shall it preclude a User from approaching a consumer forum of competent jurisdiction where available under applicable law.

24.1 These Terms shall be governed by and construed in accordance with the laws of India. Subject to Clause 23 above, and without prejudice to the rights of consumers under applicable law, the courts at Delhi shall have exclusive jurisdiction over matters arising out of or in connection with these Terms.
